1. Agreement to Terms

By accessing or using seekprogress.com ("Site"), operated by WS ASSOCIATES LLC ("Order & Progress," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Site or purchase our products.

2. Products and Services

2.1 Product Descriptions

We make every effort to accurately display our products, including descriptions, specifications, and testing documentation. However, we do not warrant that product descriptions, pricing, or other content is accurate, complete, reliable, current, or error-free.

2.2 Product Categories

Order & Progress sells:

  • Physical training equipment and apparel (shipped to US addresses).
  • Digital courses and programs hosted on Kajabi (delivered electronically, available globally).
  • Digital downloads including e-books and PDFs (delivered electronically, available globally).

2.3 Pricing and Availability

  • All prices are in USD and subject to change without notice.
  • We reserve the right to limit quantities purchased per person, household, or order.
  • We reserve the right to refuse or cancel any order for any reason.

2.4 Product Testing Claims

Our physical products are pressure-tested by real grapplers, including our founder Will Safford. Testing documentation represents actual use conditions but individual results may vary based on training intensity, frequency, and care practices.

2.5 Training and Health Disclaimer

Our courses, programs, and content provide general fitness and training information. They are not medical advice. Consult a qualified healthcare professional before starting any new training program. You assume all risk of injury related to training based on our content.

3. Orders and Payment

3.1 Order Acceptance

Your receipt of an email order confirmation does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason.

3.2 Payment Methods

We accept payment through:

  • Shopify Payments
  • PayPal
  • Stripe

All payments are processed securely. We do not store your complete credit card information.

3.3 Payment Authorization

By providing payment information, you represent that:

  • You are authorized to use the payment method.
  • Information provided is accurate and current.
  • You will pay all charges at prices in effect when incurred.

4. Shipping, Delivery, and Digital Access

4.1 Physical Products

  • Service Area: United States only.
  • Shipping Cost: $6 flat rate.
  • Free Shipping: Orders over $100.
  • Estimated Delivery: 3-5 business days from shipment.

4.2 Digital Course Access (Kajabi-Hosted)

When you purchase a digital course or program:

  • Access is provisioned via Kajabi (train.seekprogress.com) within minutes of successful payment.
  • You will receive an email from Kajabi with login credentials and a link to access your course.
  • Course access is granted for the duration specified in the product description (typically lifetime, unless otherwise stated).
  • You are responsible for safeguarding your Kajabi login credentials.

4.3 Digital Downloads (E-Books, PDFs)

Digital downloads are delivered via download link sent to your email address upon completion of payment. Links may expire after 30 days; contact us if you need a re-send.

4.4 Shipping Address (Physical Only)

You are responsible for providing accurate shipping information. We are not responsible for delays or non-delivery due to incorrect addresses.

4.5 Risk of Loss

Risk of loss and title for physical products purchased pass to you upon delivery to the shipping carrier. Digital products are deemed delivered upon successful provisioning of access.

5. Refunds and Returns

Please see our separate Return & Refund Policy for complete details. In summary:

  • Physical products: 30-day return window for unused products.
  • Digital courses: 7-day refund window, conditional on less than 20% of course content accessed.
  • Digital downloads: Non-refundable once delivered.

6. Intellectual Property

6.1 Our Content

All content on this Site and within our courses, including text, graphics, logos, images, video, audio, and software, is the property of WS ASSOCIATES LLC or its licensors and is protected by United States and international copyright laws.

6.2 Trademarks

"Order & Progress," "Mind First, Body Follows," "Forged in mind. Earned in action," and related marks are trademarks of WS ASSOCIATES LLC. You may not use these marks without our prior written permission.

6.3 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Site and any purchased digital products for personal, non-commercial purposes.

6.4 Digital Course Restrictions

When you purchase a digital course or program, you agree to:

  • Not share login credentials with anyone.
  • Not download, copy, redistribute, resell, or publicly display course content.
  • Not use course content to create competing products or services.
  • Use course content for personal training purposes only.

Violation of these restrictions may result in termination of access without refund.

7. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose.
  • Impersonate any person or entity.
  • Interfere with or disrupt the Site or servers.
  • Attempt to gain unauthorized access to any part of the Site.
  • Use automated systems to access the Site without permission.
  • Post false, inaccurate, misleading, or fraudulent content.
  • Share your course access credentials with non-purchasers.

8. Community and Reviews

8.1 User-Generated Content

If you submit reviews, testimonials, photos, or other content:

  • You grant us a worldwide, royalty-free license to use, display, and distribute such content.
  • You represent that you own or have rights to the content.
  • We reserve the right to remove any content at our discretion.

8.2 Product Reviews

Reviews must be based on actual product experience. We reserve the right to remove reviews that:

  • Contain offensive or inappropriate language.
  • Are fraudulent or incentivized improperly.
  • Violate third-party rights.
  • Are not relevant to the product.

9. Disclaimers and Limitations of Liability

9.1 Disclaimers

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WS ASSOCIATES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9.3 Maximum Liability

Our total liability to you for any claim arising from or relating to these Terms or your use of the Site shall not exceed the amount you paid for products purchased through the Site in the twelve (12) months prior to the event giving rise to liability.

9.4 Training Risk Assumption

You acknowledge that physical training carries inherent risks of injury. You voluntarily assume all such risks. WS ASSOCIATES LLC is not liable for injuries sustained while following our training content, courses, or programs.

10. Indemnification

You agree to indemnify, defend, and hold harmless WS ASSOCIATES LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the Site.
  • Your violation of these Terms.
  • Your violation of any third-party rights.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions.

11.2 Informal Resolution

Before filing a claim, you agree to contact us at info@seekprogress.com to attempt to resolve the dispute informally.

11.3 Arbitration

Any dispute not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, conducted in New York.

11.4 Class Action Waiver

You agree to bring claims only in your individual capacity and not as part of any class or representative action.

12. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Site with a new "Last Updated" date. Your continued use of the Site after changes constitutes acceptance of the modified Terms.

13. Termination

We may terminate or suspend your access to the Site and to any digital courses immediately, without prior notice, for any reason, including if you breach these Terms. In cases of credential sharing or content redistribution, no refund will be issued.

14. General Provisions

14.1 Entire Agreement

These Terms, along with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and WS ASSOCIATES LLC regarding use of the Site.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
